This comprehensive report seeks to shine a bright light on third-party litigation funding (TPLF) - a multibillion-dollar global industry with many layers which fuels mass tort lawsuits and ultimately harms patients. The industry targets and convinces unsuspecting patients with various medical devices to participate in their lawsuit, then allows investors - which could include foreign companies or governments - to invest in these lawsuits in exchange for an amount from the potential proceeds of a settlement, judgment, or verdict obtained from the claimant's legal claim. If the lawsuit is successful, the money that was provided by investors will be awarded back to that group, with interest, paid back at the time of recovery.

The report, published by the Washington Health Innovation Council, addresses five (5) essential questions:

- What is this growing problem,

- How does it work,

- Who are the main players,

- What is the impact, and

- What are the latest federal and state policy proposals?

Excepting the year's previous quarter, fourth-quarter spending on medical device injury claim ads decreased, totaling over $966,000 for approximately 6,000 ads nationwide. Notably, spinal cord stimulators emerged as a new mass tort ad target, with 111 ads aired.

Excepting the year’s first quarter, third quarter spending exceeded all prior quarters since the second quarter of 2023. Estimated spending on these ads jumped by over $280,000 or 25%.

Implanted ports remained the top medical device mass tort ad target in the third quarter as in the second and is the top medical device target of the year to date.

Implanted ports was the top target of this advertising once again with the estimated spending on these ads more than doubling from the prior quarter.

Estimated spending on medical device claims solicitation advertising increased dramatically from the first to the second quarter, when $4.25 million was spent to air these ads during television programming throughout the nation. • In June alone, spending on these ads skyrocketed from the prior month to more than $3 million—the highest in a month since October 2019. • More than 12,000 television advertisements soliciting medical device injury claims aired in the second quarter of 2023—roughly the same number that aired in the first quarter. • The monthly ad count during the quarter also peaked in June. With more than 4,100 ads airing during the month, this was the highest ad count in five months.

More than 12,000 television advertisements soliciting medical device injury claims aired in the first quarter of the year, but this was less than half that of the previous quarter. In the first quarter from January through March, over $1.3 million was spent to air these litigation-related ads and this was just over half what was spent on these ads during the October through December period. Monthly first-quarter advertising peaked in January by measure of both ad count and estimated ad spending when nearly 4,400 ads aired at a cost of about $610,000.
